Ve are concerned in North Carolina with the overall safety of the CPUT Shearon Harris plant.

3'1e are particularly upset because important population centers are being disregarded in evacuation plans (durham, Chapel Hill), but then the present evacua-tion plans for the ten mile area are already insufficient.

OP&I should above all have no extension from a full-scale evacuation plan requirement.'

understand also that E'hyllis Lotchin from Chapel Hill filed for a twenty-mile evacuation plan: has this been considered yet?

Thank you for your expression of concern and opposition to the fueling of the Shearon Harris Nuclear Plant.

I am aware that there is concern among segments of the public about the safety of the plant.

Some of this concern may come from a lack of awareness by the public of the attention given this project by the Nuclear Regulatory Commission from the time of the initial application in 1971 to the recent approval of the license.

While I understand that you are asking that I call for a moratorium on the fueling of the plant, I cannot do so since the issue of whether to fuel the plant is not within the jurisdic-tion of the State.

Rather, it is a Federal question that falls within the jurisdiction of the Nuclear Regulatory Commission.

The State's role is limited to off-site matters, particularly emergency p'arming.

I can assure you that the foremost concern of the State in this matter is the health, safety and welfare of its citizens and that everything that can be done to protect our people will be done.
