Dear Mr. Lear:

This letter is in response to your February 3,

1978 request for additional information concerning Niagara Mohawk's proposed Environmental Technical Specification changes for Nine Mile Point Unit 1.

The enclosure to your letter requested clarification and justification for changes to the non-radiological aquatic surveillance program.

Instead of answering directly each request in the enclosure, Niagara Mohawk will indicate where the information which provides the basis for the answers is contained.

The Reporting Requirements of Section 3.1.la.(1) and Objective (5) of Section 3.1.2a.(1),

of the current Nine Mile Point Unit 1 Environmental Technical Specifications, make reference to periodic review of the goals of the non-radiological abiotic and biotic aquatic programs.

Niagara Mohawk believes that the requirements of Section 3.1.la, and 3.1.2a have been met and that continuing the existing program is not required.

Niagara Mohawk notes that Section 6-1 of the Nine Mile Point 1 Final Environmental Statement states (Page 6-2):

"The general ecological survey will span at least a two (2)-year period, ending approximately in June, 1975."

Even with the delayed start-up of the James A. FitzPatrick Power Plant, this requirement to monitor the aquatic environment at Nine Mile Point has been satisfied.

Aquatic surveillance program data has been collected, evaluated, summarized, and annually reported to the Nuclear Regulatory Commission for 1973, 197/I, 1975,

1976, and 1977.

Nuclear Regulatory Commission Page Two March 7, 1978 In reference to Request 1 through 6 and Request 8 of your letter, Niagara Mohawk,believes that a basis and justification'for each of the proposed Environmental Technical Specification, changes has been adequately addressed in the annual" reports mentioned, above, and no further evaluation should be necessary.

In. reference to Request 7 of your letter, fish impingement data has, been addressed in the;annual reports; such data satisfies the requirements of the Final Environmental',Statement, and Nine Mile Point 1 Environmental Technical Specification Section 3.l.la.(2).

Additionally, a report entitled "Impingement Studies at Nine Mile Point Nuclear Station," covering.two and,one-half. years of study effort through December

1974, was submitted to the Nuclear Regulatory Commission on. April 30, 1975.

The. enclosed:.316.(a) demonstration.is provided for further justification for our. request.

This report supports the contention that Nine Mile Point Unit 1 has not adversely affected the aquatic community of Lake Ontario.
