Dear Mr. Ballaxd:
This is in response to your letter of April 16, 1982, received April 21, 1982, requesting information on the occurrence of any Endangered or Threatened species or any species proposed for listing in the vicinity of the Carolina Power and Light Cmpany's Shearon Harris Nuclear Power Units Nos.
1 and 2, Nake and Chatham Counties, North Carolina.
We have forwarded a copy of your letter to our Asheville Endangered Species Field Station, Plateau Building, Rocm A5, 50 South French Broad Avenue, Asheville, North Carolina 28801, telephone 704/258-2850, Ext. 321.
They will review the information and provide you a list of species that my occur in the area.
We would like to point out that there has been a misintexpretation of the Endangered Species Act.
Section 7(c) requires a biological assessment for construction projects begun after November 10, 1978.
As stated in your letter construction on the two units began prior to this date, therefore, a biological assessment is not required.
Hcmever, the xequirenant to con-sult (Sections 7(a) (1), (2), and 7(b) ) still applies to an agency regardless of when oonstxuction began or the stage of conpletion if the project/activity "may affect" an Endangered or Threatened species.
If you have any questions on the consultation procedures or process, please contact Mr. Bob Cooke of my staff at FTS 242-3583. If you have no questions on the consultation process then our Asheville Ehd-tngered Species Field Station willprovide you with a list of species and the type of inforrration needed to determine if the activity "may affect" any of the listed.~es.
