RE: last 3 cases I will. I can't find the still interested for 2017-0485 (Tarver) and will do that now. Then when someone gets it, all they will really have to do is close it out with the 464.

2017-0496 - I have not heard back from the requester but the email was sent through FOIAX so it's there for information. Her response is going to come into FOIA Resource if/when she responds to my message.

2017-0537 - Karen and I met on this one and 2017-0557 and she was wondering why it hadn't already been assigned to her so I'm sure she emailed you about it already.

I have met with everyone but Bobbi and will turn the two cases over to her today before I leave and let her know where I left off.

I am going to put the other case files on your desk so when they are re-assigned they are there for you to hand over.

Thanks.

First, the statement I rrnt has rio evi de,-1ce that any stgnfficant amount qf strat~gic.SNM has ever been stolen or diverted~,* on page. 2 of the first inventory dfffererice report, tlllREG-0350, must b~ understpod to apply only tc;:i the post-1 %8 period to which the report applies~

St:.cond *. with regard to the NtJMEC matter itself, an appr;}ptia*te char:act~rization is that, based on informatton available to thr-Corini1issiori at the present tfrr.e, there is no conclusive evidence that a, diversion of a s1gnificant amoimt of strategic SNM.either did or did not take place.

Third, the Co1,;ii:ission belie.yes that unqualtfied 1 no evidence' state111ents sh~fuld, be avoided in chara:cte:rizing inventory difference ina.tters.

since ¢vei1 a, zero inventory di.fference does not conclusively dedonstrate that mater,a 1 has not beeri diverted.

Q~al i fied 1 no evid~ncc' s tatcm1ents should not imply a higher 'degree of confidence I

than the situation 1<1arrants.

The staff judgments as to the pos-sibility of theft or diversion of SNM are based on a combination of factors, including physical security measures at a facility and material accounting and control measures, and should be characterized as judgments rather than proof.

Fourth, in dealing with the pre-1968 sategu, irds dQta, staff statements should note that such data predate any regulatory staff activity and derive from a period in which safeguards measures were far less stringent than at present.

"The staff should develop, for Colil;,1ission consideration. a general statement concerning the conclusions* that can be made about theft and diversion of significant amounts of strategic SNM, based on the above.

"~lith re9ard to R~c:o:'.'jTjendation 4.* the Co;.~nission wishes the staff to identify instances of allegeQ successful thefts or diversions of strategic special nuclear material.

The list of such inst.rnces should include, to tne extent possible, those mentioned by Mr. Conran in his July 29, 1977, testi~ony.

The list should be in a fonn suitable f~r filing in the Public Docum~nt Room, except that classified inforrr;dtion should be segregated in a suitable classified supplement.

Th~ Cor:;:nission believes a comprehensive tabulation of such matters, along the lines of the recently prep.1red 'threats list' is desir,'!ble.

"Co~1mi s.s inn discussions on other r.1d t te rs, in connection with the Inquiry Report, including its findings Jnd conclusions, rlill take:

place at future rr.eetings. .

Please take the action requested by the Com'llission and advise me of the proposed briefing dates for scheduling purposes.
