Dear Ms. Curran:
I am responding to the request for a stay of the effectiveness of a final no significant hazards consideration (NSHC) determination contained in your February 12, 1999, submittal, "Orange County's Comments in Opposition to No Significant Hazards Determination and Conditional Request for a Stay of Effectiveness."
Your submittal was made in response to the Nuclear Regulatory Commission (NRC) staff's proposed NSHC determination with respect to Carolina Power & Light Company's (CP8 L's) proposed increase in the spent fuel storage capacity at the Si H

In your submittal, you requested, on behalf of Orange County, that the staff stay the effectiveness of any final NSHC determination for 10 days so that Orange County may appeal the determination.
You further requested in your submittal that the staff respond to your stay request at least 10 days before issuing the license amendment so that Orange County may be apprised of the need to take appropriate alternative measures to preserve the status quo.
The Commission's regulations, in particular those in 10 CFR g 50.58(b)(6), provide that no request for review of the staff's NSHC determination willbe entertained by the Commission and that the staff's determination is final, subject only to the Commission's discretion, on its own initiative, to review the determination.
The Commission's regulations do not expressly provide for the actions you requested.
In light of this, the staff does not intend to stay the effectiveness of any final NSHC determination.
