NRC INTEGRATED INSPECTION REPORT 5(4400/98-11
Dear Mr. Scarola:
On January 30, 1999, the NRC completed an inspection at your Shearon Harris facility. The
enclosed report presents the results of that inspection.,
During the six-weeks covered by this inspection period, our inspectors found that your staff
generally took a safety-conscious approach to the operation of the facility.
Based on the results of this inspection, the NRC has determined that violations of NRC
requirements occurred. These violations are cited in the enclosed Notice of Violation (Notice),
and the circumstances surrounding the violations are described in detail in the enclosed report.
One'of the violations identified in this report is repetitive; as described in Section E8.1.
Repetitive violations are addressed
in the NRC's "Statement of Policy and Procedure for NRC
Enforcement Actions," (Enforcement Policy), NUREG 1600,Section IV.B.,The Enforcement
Policy allows the severity level of a violation to be increased ifthe violation can be considered
repetitive. For example, a Severity Level IVviolation could be increased to Severity Level III
with the attending escalated enforcement action. However, in this case, we have decided not to
increase the severity level of this violation based on the changes which you recently
implemented In your Corrective Action Program, and your subsequent satisfactory performance
in this area..
You are required to respond to this letter and should followthe instructions specified in the
enclosed Notice when preparing'your response.
The NRC willuse your response,
in part, to
determine whether furtlierenforcement action is necessary to ensure compliance with
regulatory requirements.
