DEPARTMENT OF LABOR (DOL) CASE NO. 98-ERA-31 (MICKEYR. HAMBYv. CAROLINAPOWER 8 LIGHT, INC.)
Dear Mr. Donahue:
On December 11, 1997, the U.S. Department of Labor's (DOL) Occupational Safety and Health Administration in Washington, D.C, received a complaint filed by Mr. Mickey R. Hamby, a former employee of Carolina Power 6 Light's (CPBL) Shearon Harris Nuclear Power Plant. On October 19, 1998, you were advised that the NRC's Office of Investigations (Ol) had completed an investigation of the compliant which did not substantiate that discrimination occurred.
However, you were advised that NRC would hold its judgement on whether or not enforcement action was warranted in this matter until after an adjudicatory decision by a DOL Administrative Law Judge (ALJ).
On November 25, 1998, the DOL ALJ issued a Recommended Order of Dismissal (RDO) in the case approving a settlement agreement between CPB L and Mr. Hamby. Based on the RDO and that the settlement met the requirements of 10 CFR 50.7, the NRC staff's monitoring of DOL activities has been completed.
This concludes the NRC's activities regarding this matter.
