NOTICE OF VIOLATION Carolina Power 8 Light Company Shearon Harris Unit 1 Docket No. 50-400 License No. NPF-63 During an NRC inspection conducted from September 27 to November 7, 1998, a violation of NRC requirements was identified. In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:
10 CFR 50, Appendix B, Criterion III, Design Control, requires in part, that measures be established to assure that applicable regulatory requirements and the design basis, as defined in 10 CFR 50.2, Definitions, and as specified in the license application, are correctly translated into specifications, procedures, and instructions.
Plant Change Request
- 3008, Revision 1, established service life and replacement frequencies for safety-related Agastat E7000 Series Emergency Diesel Generator relays TD/1991, TD/2011, TDA/1991, TDA/2011 and Reactor Protection System relays 2-1/455 and 2-2/455.
Contrary to the. above, as of November 3, 1998, the licensee had failed to correctly translate design basis requirements, as specified in Plant Change Request 3008, for the control of safety-related Agastat relay service life and replacement frequencies into maintenance procedures which specified required replacement frequencies for relays with tag numbers TD/1991, TD/2011, TDA/199, TDA/2011, 2-1/455, and 2-2/455 This is a Severity Level IV Violation (Supplement 1).
I The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence and the date when full compliance will be (was) achieved is already adequately addressed on the docket Inspection Report No. 50-400/98-09 dated December 7, 1998. However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position.
In that case, or if you choose to respond, clearly mark your response as a "Reply to a Notice of Violation,"and send itthe U. S. Nuclear Regulatory Commission, ATTN:Document Control Desk, Washington, DC 20555 with a copy to the Regional Administrator, Region II, and a copy of the NRC Resident Inspector at the facilitythat is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).
