Shearon Harris Nuclear Power Plant, Unit 1 - Informal Complaint Filed by the North Carolina Eastern Hunicipal Power Agency:

Progress Reports Pursuant to Ongoing Arbitration

Dear Hr. Avery:

The staff, by letter dated January 22, 1990, to Gary J. Newell, counsel for the North Carolina Eastern Hunicipal Power Agency (Complainant),

requested Complainant to, 1) identify those issues not being addressed in the arbitration proceeding between your client, Carolina Power 5 Light Company (CPhL) and Complainant that would fall within the jurisdiction of the Nuclear Regulatory Coomission, and 2) provide monthly, written status reports of the arbitration proceeding.

By letter dated February 23, 1990 (copy attached),

Complainant furnished a

response to staff's request.

Complainant did not identify, as requested, any issues outside of the arbitration proceeding that should be addressed by the Nuclear Regulatory Commission.

Based upon the information made available to the staff to date, the staff believes that the concerns raised by Complainant are being addressed in the arbitration proceeding involving the 1981 Power Coordination Agreement between CPEL and Complainant.

The staff is concerned with the issues being addressed in the arbitration proceeding and has requested Complainant to file written monthly status reports pursuant to the arbitration proceeding.

Me.would appreciate it if COL would also furnish the staff with written monthly status reports of the arbitration proceeding beginning April 2, 1990.
