SUBJECT:

NRC STAFF MEETING WITH REPRESEN'TATIVES OF CASH (DECEMBER 10, 1986)

On Monday, December 8,

19II6, Mr. Billy Cummings, a representative of Coalition for Alternatives to Shearon Harris (CASH) made a request by telephone that a meeting be arranged between Harold Denton,

Director, NRR and representatives of CASH to discuss the proposed granting of a full power license for Shearon
Harris, particularly the scheduling of December 18, 1986 as the date for the Commission to consider the matter and the pending 10 C.F.R.

II 2.206 petition.

Mr. Cummings indicated he would be in Washington, D.C. during the time period of December 10-11, 1986.

A meeting was scheduled and held at 2:00 pm on Wednesday, December 10, 1986.

The Applicants requested and were granted the right to attend the meeting as observers.

The Attorney General of North Carolina's representative was offered the right to attend the meeting as an observer by means of a conference telephone hookup but determined not to participate in the meeting.

Treby and briefed on the topics discussed during the meeting.

The topics discussed during the meeting were:

1)

CASH indicated fts dismay about the scheduling of a meeting for the Commission to consider the full power Shearon Harris license for December 18,

1986, a date by which CASH understood the fadlity would not have gone critical or conducted any low power operation.

During the discussion of this matter, it was noted that the Commission's calendar needs to be prepared several weeks in advance so that the Commission and its staff can schedule its work.

A date on such a calendar is necessarily tentative, although it does become firmer as the date approaches.

At the time the December 18, 1986 date was selected to discuss the licensing of Shearon Harris, it was perceived that the fuel loading and low-power testing would be further along.

However the reality was that the facility would not reach criticality until after December 18, 1986

and, having been informed of this fact and other outstanding matters by his staff, Mr. Denton had.determined to seek to reschedule the Commission meeting to consider the licensing of Shearon Harris to a date during tlie week of January 5, 1987.

CASH inquired as to the Commission decision of December 5,

1986 denying Wells Eddleman and CASH's request for a hearing on CPaL's exemption request.

During the discussion of this matter, CASH was advised that the decision was final agency action on the request for hearing.

The Staff will issue the exemption when

needed, i.e.,

simultaneously with issuance of a full-power license.

CASH indicated concerns about emergency preparedness.

During the discussion of this matter, CASH particularly noted its belief that appropriate people in Chatham County lacked the necessary training and inquired about the testing of the sirens in the EPZ.

4)

CASH indicated that, based on rumors heard by its members, it had concerns as to the. adequacy of the Staff's investigation in the matters raised in its pending 10 C.F.R 0 2.206 petition.

The areas of CASH's concern were:

1) whether the Staff had delegated the investigation to CPaL.

2)

The length of time it took from the filing of the petition until the Staff began its investigation.

3)

CASH's perception that the Staff's investigation appears to be concentrating on reviewing prior Staff documents.

4)

CASH's perception that the Staff inspectors have not looked into the specific documents identi6ed in the petition.

During the discussion of this matter, H. Denton indicated he would look into the procedures followed by the Staff in its investigation into the items raised in the petition.

He stressed that it would be very helpful to the Staff's investigation if the alleger would meet face to face with a Staff member so that a clear understanding could be gained of the allegations.

H. Denton noted that in the past he has made special arranges to effect such meeting with safeguards to preserve the alleger's confidentiality to the greatest extent possible given the provisions of the Freedom of Information Act.

He urged CASH to give serious considera-tion to aiding him in arranging such a meeting.

CASH requested H. Denton to again come down and look at the Shearon Harris plant to determine for himself its readiness for a

fuQ power license

and, perhaps while at the
site, to look into the Staff's investigation into the 10 C.F.R. 0 2.206 Petition.

During the'discussion of this matter, H. Denton stated he had been considering making a site visit during the December 17-18, 1986 time

period, 6)

CASH suggested H. Denton look into allegations regarding harassment and intimidation of workers at the facility such as the claims made with the Department of Labor.

Consideration will be given to this suggestion.
