V 7590-01 UNITED STATES NUCLFAR REGULATORY COMMISSION CAROLINA POWER A LIGHT COMPANY NORTH CAROLINA EASTERN MUNICIPAL POWER AGFNCY DOCKFT NO. 50-400 NOTICE OF ENVIRONMFNTAL ASSESSMENT AND FINDING OF NO SIGNIFICANT IMPACT The U.S. Nuclear Regulatory Commission (the Commission> is considering issuance of an exemption from a portion of the requirements of Appendix E to 10 CFR Part 50 to the Carolina Power 8 Light Company (CPSL>,

and North Carolina Eastern Municipal Power Agency (the licensees) for the Shearon Harris Nuclear Power Plant, Unit 1, located in Wake and Chatham Counties, North Carolina.

The exemption was requested by the licensees by letter from CPEL dated March 4, 1986.

ENVIRONMENTAL ASSESSMENT Identification of Proposed Action:

The exemption will permit the licensees, following the Commissi'on s

issuance of a full power operating license for the facility, to operate the unit above Si. of its rated power without conducting another offsite full participation emergency preparedness exercise prior to February 1987.

Section IV.F.I of 10 CFR 50, Appendix E, requires that a full participation exercise of the offsite emerqency preparedness plans be conducted within I year prior to operation above 51 of rated power.

The Harris emergency plan was previously exercised on May 17-18 1985, with State and local participation.

The Need for the Pro osed Action:

The proposed exemption is needed to permit the licensee to proceed with operation above 5X of rated power prior to conducting another offsite emergency preparedness exercise.

The next exercise with full participation at the State and County level is presently scheduled for February 1987.

This date would not be timely for Harris, which is expected to be ready in January 1987 for operation above 5% of rated power.

Environmental Im act of the Pro osed Action:

The exemption would not affect the environmental impact of the facility because the level o" emergency preparedness will not be degraded by its issuance.

Both FFNA and the NRC concluded from the May 1985 exercise that the results provide reasonable assurance of'dequate offsite emergency preparedness relative to the Harris Plant.

Therefore, the proposed exemption does not involve a significant radiological environmental impact.

In addition, the action would have no effect on nonradiological environmental impacts associated with the Harris Plant.

Alternative to the Pro osed Action:

Because the staff has concluded that there is no sianificant impact associated with the proposed exemption, any alternative to the exemption will have either no environmental impact or greater environmental impact.

The NRC staff consulted FEMA regarding its report of the May 1985 exercise.

No other agencies or persons were contacted.

FINDING OF NO SIGNIFICANT IMPACT The Commission has determined not to prepare an environmental impact statement for the proposed exemption.

Based upon the environmental assessment, we conclude that proposed action will not have significant effect on the ouality of the human environment.

The Commission has, therefore, determined not to prepare an environmental impact statement for the proposed exemption.
