Stello This is to acknowledge receipt of your petition dated October 17, 1986, filed pursuant to 10 CFR 2.206, requesting issuance of an order to Carolina Power 5 Light Company requiring it to show cause why its construction permit for the Shearon Harris facility should not be modified or revoked and issuance of its operating license delayed in light of the issues you raise.

We are evaluating the issues you have raised.

As you know, we issued the low power license for Shearon Harris on October 24, 1986.

Prior to issuance of the

license, we screened the issues raised in your petition in accordance with our policy for handling late allegations and determined that the issues raised did not present significant safety concerns which needed to be resolved prior to issuance of the operating license (OL).

Consequently, a final evaluation and response to the issues raised in your petition were not completed prior to issuance of the OL for the Shearon Harris facility, but as provided in 10 CFR 2.206, we will respond to your request within a reasonable time.

Enclosed for your information is a copy of a notice which is being filed with the Federal Register.
