Joseph Huahes and Steven Katz, on behalf of the Coalition for Alternatives to Shearon Harris (CASH), and Mr. Wells Eddleman, that the Ofrector, Office of Nuclear Reactor Reaulation institute a show cause proceeding pursuant to 10 CFR 2.202 to address

certain issues raised by the petition and to withhold issuance o< the operatina license for the Shearon Harris Nuclear Power Plant until these issues are addressed in a hearfna.

Specifically, the petition requested that:

I) the applicant be required to redemonstrate the adequacy of fts emergency planning capabilities in liaht of the decision by Chatham County to withdraw from participation fn the emeraency plan and alleaed deficiencies fn the applicant's emergency plan demonstrated by an emergency siren actuation incident on June 2F.,

1986;

2) the applicant be required to comply with 10 CFR 50.47(a)(2) concernina conductina a full scale exercise within one year before full power operatior;
3) the Conmfssion investigate alleaations by Ms. Patty Mfriello concernina falsification of records of employee radiatfor, exposures, deficiencies in the

coolant line welds; and 41 the Commission prepare a supplemental Fnvironmental Impact Statement and consider psychological distress to residents of the surrounding area in light'of three new sicnificant circumstances:

a) the Chernobyl accident; b> the false siren incident; and c) the Chatham County pull-out.

The Director, Office of Nuclear Reactor Regulation, has determined to deny the request for a show cause proceeding.

The reasons for this decision are explained in the "Director's Decision Under 10 CFP. 5?.206",

A copy of the Decision will be filed with the Secretary for the Commissior.'s review in accordance with 10 CFR 2.206(c).

As provided in this regulation, the Decision will constitute the final action of the Commission twenty-five (25) days after issuance, unless the Comnission, on its own motion, institutes review of the Decision within that time period.
