Dear Chairman Zech:
I believe the health and safety of North Carolina residents should not be compromised for the convenience of the Carolina Power and Light Company.
Specifically I am referring to COL's request for an exemption from conducting a Full Participation Emergency Exercise before its commercial operation is permitted.
Since the Exercise was last performed, a number of revisions have been made.
The improvements in the Shearon Harris Emergency
Response
Plan agreed to by CHAL and the North Carolina Department of Crime Control and Public Safety point to the inadequacy of the Plan as it was last tested.
Also, I have spent time researching the outcome of the last Exercise, and although the initial comments for each county indicate satisfaction, the reports indicate there were many shortcomings.
These shortcomings are presumed to be addressed yet a Full Participation Emergency Exercise is needed to prove that indeed they have been adequately resolved.
Therefore I request that the NRC compel CMcL to comply with the provisions of 10 CFR 50, Appendix E, Section IV.F.l and conduct a Pull Participation Emergency Exercise before the Shearon Harris plant is authorized to begin operation.
