Dear Ãr. Chairman:
In your letter of November 7, 1978, addressed to Chafrman Hendrfe you prevfded us with an opportunfty to comment on a letter you received from ftrs. Frederick Maage of Pittsboro, North Carolina, regarding a public hearfng on the Shearon Harris nuclear power plant.
At present a public hearing is in progress before an Atomic Safety and Licensing Board with respect to certain aspects of the application for licenses for the Shearon Hairfs plant.
Because Chairman Hendrie and the other members of the Commission, fn connection with their adjudicatory responsibilities, may review the results of that hearing, ft was considered inappropriate for the Chairman to respond to your inquiry.
Accordingly, I have been requested to covalent on f/rs. Waage's concerns.
Mrs. Haage suggests that the license proceeding for the Harris facility be reopened to consider Carolina Po<<er and Light, Company's future need for the plants nev under construction.
The evidentiary hearings held fn Raleigh, North Carolina last year on the application for the Shearon Harris facility dfd. in fact, specifically deal wfth the need-for power issue.
The t)uclear Regulatory Commission Staff and the North Caro'tina Public Utilities Comnission (NCPUC) independently forecast future peter needs fn Carolina Power and Light Company's service area.
Carolina Peter and Light Company introduced its own forecast.
Intervenors in the proceeding consisting of h<o men>hershlp groups contested those forecasts.

The Honorable Gary Hart Carolina Power and Light Company service area.
The Carolina Power and Light Company forecast had the lowest average annual compound growth rate.
Based upon the hearing record, the latest forecasts of Carolina Power and Light Company and the HCPUC, the Licensing Board made its own forecast and concluded that the foul Shearon Harris units would be needed within the time frame requested in the appli-cation in order to provide an adequate and reliable supply of electric power in Carolina Power and Light Company's service area.
The intervenors in this proceeding appealed this need-for power finding.
The Comnission's Appeal Board evaluated this appeal and based upon the entire record sustained the findings that the facility would likely be needed.
On September 5, 'l978, the Comission directed that the Licensing Board take further evidence regarding Carolina Power and Light Company's technical qualifications to construct and operate th'e Shearon Harris facility on)y.
This hearing which will not involve the need for power, will be held in Raleigh, North Carolina early in 1979.
A copy of the notice of the time and place of the hearing will be sent to Mrs. Maage.

This is in response to your letter of oyember 7, 1978, to Chairman Hendrie of this Commission, transmitting the ogcerns of Mr. Hilliam S.- Baker of Chapel Hill, North Carolina. on the hyperon Harris facility of the Carolina Power and Light Co.

Mr. Baker asserts that no one in tii vicinity of the proposed facility had any voice in the licensing proce ing and further questions the policy of producing electricity through sing nuclear reactors.
The public was given notice of this proceeding.
and participated in it.
A notice of hearing on the application by Cqrolina Power and Light Co. for construction permits for the four Shearon, Ha ris units was published on September 21, 1972.
Two individuals and two environmental groups responded.
The environ-mental groups were admitted as intervenors in this proceeding and actively participated in the many, man days of hearings held in Raleigh, North Carolina, which resulted in initial decision granting construction permits in January.
1978.
T us, the public in the area of the proposed facility has been deeply in olved in this proceeding since its inception.
On September 5, 1978, the ommission directed that the Licensing Board take further evidence regardin Carolina Power and Light Company's technical qualifications to constr ct and operate the Harris facility.
