Pagel of 2 Even if the news that Russia has purchased a substantial stake in the United States uranium reserve is easily proven to be a political response to discredit a Clinton presidency, are you not concerned that a nuclear component is sold and traded to a foreign power having ambitions in conflict with our own.

Frankly learning this news makes my faith in this country's ability to make a better living for my grandchildren as reasonable as winning the next lotto and buying a retreat in Samoa.

Obviously all commercial news (even Fox) missed this story when it happened, yet the business venture required government approval from the Obama administration. That was easily obtained. Since your office saw little need to inform me of this transaction, I must conclude that this transfer of mineral rights truly poses no problem to my family.

So please have someone in your office pass along to me the inside insightful knowledge that I expect my representative in government has at hand and eliminate my fears that (I) such material would never be passed to Middle East powers for purpose of competing in the future race to secure nuclear capability equivalent to other successful foreign powers seeking such a pulpit; (2) that an open transparent government as promised by this administration retains-such a promise since this transaction has such minimal affect upon its citizens; (3) that financial influence was paid little head as the purpose of the transfer was to improve the commercial well being of two foreign powers.

This remaining year and a half of a presidential span historically centers about an authoritative rush to accomplish a historic foo,tprint not withstanding trampling whoever steps in the \\vay. I don't expect you, Congressman, to take an independent stance in any remaining voted you'll will cast but I truly expect you to keep vigilant in protecting your office and the powers your branch of government was given by the Constitution. I believe these duties are secure when you office continues to inform our district of what happens in Washington.

I would hope your staff wilJ be informative responding to my request as I see more frequently Washington hiding from common sense and game playing political volleyballs as being the reason for their political careers.

The information sought to be withheld is contained on page 4 of ConverDyn's Applicationfor NRC Export/Import License, Amendment, or Renewal.

In making this application for withholding the proprietary information of which it is the owner, ConverDyn relies upon the exemption from disclosure set forth in

  • the Freedom oflnformation Act ("FOIA), 5 USC Sec. 552(b)(4), and the Trade Secrets Act, 18 USC Sec.1905, and NRC regulations IO CFR 9.l 7(a)(4), and 2.790 (a)(4) for "trade secrets and commercial or financial information obtained from a person and privileged or confidential" (Exemption 4). The material for which exemption from disclosure is here sought is all "confidential commercial information," and some portions also qualify under narrower definition of"trade secret," within the meanings assigned to those terms for purposes of FOIA Exemption 4 in, respectively, Critical Mass Energv Project v. Nuclear Regulatory Commission, 975 F2d 871 (DC Cir. 1992.

Some examples of categories of information which fit into the definition of proprietary information are:

a. Information that disclos~s a process. niethod, or apparatus, including supporting data and analyses, where prevention of its use by ConverDyn 's competitors without license from ConverDyn constitutes a competitive economic advantage over companies;

The information is of a sort customarily held in confidence by ConverDyn, and is in fact so held. Its initial designation as proprietary information, and the subsequent steps taken to prevent its unauthorized disclosure, are as set forth in (6) and (7) following. The information sought to be withheld has, to the best of my knowledge and belief, co:risistently been held in confidence by ConverDyn, no public disclosure has been made, and it is not available in public sources. All disclosures to third parties including any required transmittals to NRC, have been made, or mi.1st be made, pursuant to regulatory provisions or proprietary agreements which provide for maintenance of the information in confidence.

Initial appro,;al of proprjetary treatment of a document is made by the President and CEO, the person most likely to be acquainted with the value and sensitivity of the information in relation to industry knowledge. Access to such documents within ConverDyn is limited on a "need to know" basis.

The procedure*for approval of external release of such a document typically requires review by the President and CEO, by the manager of the cognizant marketing function ( or his delegate); and by the Legal Operation for content, competitive effect, and determination of the accuracy of the proprietary designation. Disclosures outside of ConverDyn are limited to regulatory bodies, customers, and their agents, and others with a legitimate need for the iiiformation, and then only in accordance with appropriate provisions or proprietary agreements.
