By letter dated February 20, 1985, we requested your Company to remit a
$150 application fee for your application dated February 1, 1985.
This application provided a reanalysis of spent fuel pool rerack regarding liftoffduring a seismic event for the Turkey Point Plant Unit Nos.
3 and 4.
This fee has not been received by us.
By letter dated February 26, 1985, the ONRR s'taff informed your Company that they would not take any further action on your application until clarification is received on whether {1) a 50.59 review had been done in accordance with 50.59(a) and (b), or (2) it is determined that the reanalysis requires a change to the Technical Specifications.
Under the provisions of 10 CFR 170.12(a) and Footnote 2 to the Schedule of Facility Fees in 10 CFR 170.21, the application fee of $150 is applicable irrespective of the Commission's disposition of an application or withdrawal of the application.
Even though the February 1 application might be withdrawn by your Company at a later date, the $150 application fee requested in our February 20 letter is still appropriate and due.
Also, if there are additional costs above and beyond
$150 associated with the minimal action taken on it as addressed in the ONRR staff's February 26, 1985 letter and prior to its withdrawal. your Company will be billed at a later date in accordance with 10 CFR 170.12(c) and 170.21.
Ifyour February 1 request is modified because you determine that a change in technical specifications is necessary or that an unreviewed safety question exists, an additional application fee is not necessary to accompany the modification to your February 1 application.
