IN RESPONSE REFER TO FOIA-83-615 This is a second partial response to your letter dated October 20, 1983 in which you requested, pursuant to the Freedom of Information Act, that copies of documents be made available at the Nuclear Regulatory Comrission's (NRC) Public Document Room (PDR) regarding all documents concerning the incident at Turkey Point Units 3 and 4 described in Enclosure B, page 2, of the Weekly Information Report for the Week Ending October 7, 1983.
Portions of document 1 and documents 2.and 3 as listed on Appendix A are responsive to your request and are being placed in the NRC Public Document Room.
With regard to Document 1
(Appendix A) we have deleted the name of the individual who received the disciplinary action (page
- 1) and the Report of Discipline dated October 6, 1983 because disclosure of this information constitutes a clearly unwarranted invasion of personal privacy.
This information is being withheld from public disclosure pursuant to Exemption (6) of the Freedom of Information Act (5 U.S.C. 552(b)(6))
and 10 CFR 9.5(a)(6) of the Commission's regulations.
The undated draft Inspection Report as listed on Appendix B is being withheld in its entirety because it is predecisional in nature and disclosure would be premature because the contents of this record constitutes preliminary findings, conclusions or recommendations that has not been adopted by the agency.
This predecisional information is being withheld pursuant to Exemption (5) of the Freedom of Information Act (5 U.S.C. 552(b)(5))
and 10 CFR 9.5(a)(5) of the Commission's regulations.
Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest.
The persons responsible for this denial are the undersigned and Nr. Dames P. O'Reilly, Administrator, Region II.

>993 This denial may be appealed to the Commission's Executive Director for Operations within 30 days from the receipt of this letter.
As provided in 10 CFR 9.11 any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Comnission, Washington, DC 20555, and should clearly state on -the envelope and in the letter that it is an "Appeal from an Initial FOIA Decision."
The NRC has not completed its review of.the remaining documents subject to your request.
We will respond as soon as that review is completed.
