This will acknowledge receipt of your letters

dated

March

14 and March 29, 1988,

and your check for $ 150,000 in payment for the civil penalty

imposed

by the

NRC

t

in

a letter dated

February

11,

1988.

We are concerned

both with the accuracy

and the substance

of your response.

Of

the firstconcern,

we note that there were

a number of inaccuracies

in your

letter of March 14,

1988.

During our meeting with FPSL management

on April 21,

1988,

we discussed

the fact that the internal review of the matter

by FPSL was

insufficient.

While any inaccurate

information is cause for concern,

the

incorrect information concerning

the implementation of a preventive

maintenance

program of locks is of particular concern.

Accordingly,

a violation of 10 CFR 50.9

is being issued.

Elements

to be included in your response

are described

in the

enclosed

Notice of Violation.

On the matter of substance,

we find your corrective action of providing FPIIL

supervision of the contractor

guard force on a 24-hour basis

"by the end of

the year" to be inadequate

in that it is not timely.

As discussed

with you in

early April and again

on April 21,

we are concerned with your decision to delay

providing this supervision

since

we consider it to be

an essential

step in pro-

viding on-site guidance,

supervision,

and regulatory sensitivity to the security

force operation.

We understand

that you have taken steps

to provide

a more

timely completion.

Please

provide

a supplementary

response,

within 30 days of

the date of this letter, that specifies

the steps

taken

and the present

completion date.

In accordance

with Section

2.790 of the NRC's "Rules of Practice',"

Part 2, Title

10,

Code of Federal

Regulations,

a copy of this letter and its enclosure will be

placed in the

NRC Public Document

Room.
