ENCLOSURE 1

NOTICE OF VIOLATION Florida Power and Light Company Turkey Point Docket Nos.

50-250, 50-251 License Nos.

DPR-31, DPR-41 During the Nuclear Regulatory Commission (NRC) inspection conducted on May 11-15,

1987, a violation of NRC requirements was identified.

The violation involved failure to follow the intent of Administrative Procedure AP 0103.2 to adequately prevent excessive overtime by operator personnel in that overtime restriction commitments were abused.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C

(1986),

the violation is listed below:

10 CFR 50, Appendix B, Criterion V, and the licensee's accepted Quality Assurance (QA)

Program (FPL-NQA-100A, Revi sion 8) collectively require that activities affecting quality be prescribed by procedures and be accomplished in accordance with these procedures.

Administrative Procedure 0103.2, Responsibilities of Operator And Shift Technicians On Shift And Maintenance Of Operating Logs And Records, Overtime Assignments, dated September 9,

1986, specifies the below listed operator overtime restrictions to be followed in event that overtime is unavoidable.

An'ndividual should not be permitted to work more than 12 hours1.388889e-4 days <br />0.00333 hours <br />1.984127e-5 weeks <br />4.566e-6 months <br /> straight (not including shift turnover time) 2.

There should be a break of at least 12 hours1.388889e-4 days <br />0.00333 hours <br />1.984127e-5 weeks <br />4.566e-6 months <br /> (which can include shift turnover time) between all work periods.

An individual should not work more than 72 hours8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br /> in any 7-day period.

An individual should not be required to work more than 14 consecutive days without having two consecutive days off.

Contrary to the

above, a review of the 1986 time cards for five randomly selected operators identified frequent overtime was worked and the following overtime restrictions were violated.

Two of the five operators worked a 14-day shift 2.

Two of the five operators had a work break of less than 12-hours between work periods.

3.

Four of the five operators (on 9

separate instances) were found to have worked more than 72-hour's in a 7-day period.

Three of the five operators worked more than 14 consecutive days without having two consecutive days off.

This is a Severity L'evel IV. violation (Supplement II).

Pursuant to the provisions of 10 CFR 2.201, Florida Power and Light Company is hereby required to submit to this Office within 30 days of the date of the letter transmitting this Notice a written statement or explanation in reply including: (1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results

achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved.

Where good cause is shown, consideration will be given to extending the response time.
