'OTICE OF VIOLATION Florida Power and Light Company Turkey Point 3 and 4

Docket Nos.

50-250 and'50-251 License Nos.

DPR-31 and DPR-41 As a result of the inspection conducted on December 9,

1980, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980),

the following violation was identified.

10 CFR 71.5(b) requires that "the licensee comply with the applicab'le require-.

ments of...

49 CFR Parts 170 189."

49 CFR 173.392(c)(1) requires that "Materials must be packaged in strong, tight packages so that there will be no leakage of radioactive material under conditions normally incident to transportation,"

Contrary to the

above, on December 9,
1980, 21 barrels in this shipment delivered to the Chem-Nuclear burial site at Barnwell, South Carolina were not strong, tight packages in that there were punctures in the sides which permitted the contents to spill onto the trailer bed.

This is a Severity Level III Violation (Supplement V.C.(l)).

Pursuant, to the provisions of 10 CFR 2.201, Florida Power and Light Company is hereby required to submit to this office within twenty-five days of the date of this Notice, a written statement or explanation in reply, including:

(1) admission or denial of the alleged violation; (2) the reasons for the violation if admitted; (3). the corrective. steps which have been.

taken and the results achieved; (4) corrective steps which will be taken to avoid further violations; and (5) the date when, full compliance will be achieved.

Under the authority of Section 182 of the Atomic Energy Act of 1954, as

amended, this response shall be submitted under oath or affirmation.
