LICENSEE'S MOTION FOR '

SUMMARY

D.ISPOSITION OF CONTENTION 8 Pursuant to 10 CFR g 2.749, Florida Power 5 Light Company ("FPL" or "Licensee" ) moves for summary disposition, in its favor, of Contention 8.

Contention 8 states:

The proposed method of radiation monitoring during repair of the steam generators will not provide accurate information to comply with 10 CFR Parts 20 and 50.

The grounds for this motion are that, as to the matters raised i n this contention, there exists no genuine issue of material fact and that Licensee is entitled to a favorable decision as a matter of 'law.

Attached hereto is the affidavit of Harvey F. Story and a statement of material facts as to which there is no genui'ne i ssue. The page references i n the statement of material facts refer to page numbers in Mr. Story's affidavit.
