Re: Turkey Point Units 3 and 4 Docket Nos. 50-250 and 50-251.

Proposed Amendment to Facility 0 eratin Licenses DPR-31 and DPR-41 In accordance with 10 CFR 50.30, Florida Power & Light Company submi,ts herewith three (3) si gned originals and forty (40) copies of a request to amend Appendix,A of Facility Operating Licenses DPR-31 and DPR-41.

The proposed amendment is described below and shown on the accompanying Technical Specificati'on page bearing the date of this letter in the lower ri ght.'hand corner.

~Pa e 1-6 Technical Speci'fication. 1.16.1 (Fuel Residence Time Limit) is deleted, for reasons discussed in the attached safety evaluation.

Specification 1.16.2 is renumbered 1.16.

The proposed amendment.has been reviewed by the Turkey Point Plant Nuclear Safety Committee and the Florida Power, & Light Company Nuclear Review Board.

They have concluded that it does not involve an unreviewed safety question.

'esign, fuel,burnup. and the core operating environment. For, exampl'e, Unit 3 has a. predicted clad flattening time in excess of 50,000 EFPH, for Cycle 5 '(no i.ni:tial core fuel), and Unit 4 has a 34,'000 for Cycle 5. Both units satisfy Technical Specification 1.16.1. EFPH'alue for the present Cycle 5 operations. However, this speci.fication can be unnecessarily, restrictive on allowable fuel burnups in future reload cycles.

A fuel residence time Technical 'Specification limi.t is not needed since each fuel region is checked during a,reload design, process to assure that clad fl'attening is not predicted. 'Further,,for each reload cycle our Turkey Point Plant 'Nuclear Safety Commi'ttee reviews and approves the Reload Safety Evaluation (RSE) report, which documents that clad flattening is not predicted during the upcoming cycle. It is noted that most operating plants do not have fuel residence time limitations

.based'n clad flattening, but these plants do assure that a no-clad-flattening design, basis is satisfied as a result of the reload design process and revi ew.

Con cl us.i ons Based on the considerations discussed above, (1), the amendment does not involve a signifi'cant increase in the,probabili,ty or consequences of accidents previously consi'dered and does .not involve a significant decrease in a safety margin, (2') there is reasonable assurance that the health and safety of the publ'ic wi'll not be endangered by operation in. the .proposed manner, and (3) such acti.vi,ties will 'be conducted in compliance with the Comnission's regulations and the issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public.
