Gentlemen:

Your letter dated December 18, 1978 (L-78-389), (1) stated your objec-ti'on to our position that all the criteria of the last sentence of Footnote 2 of 10 CFR 170.22 must be met in order for a request. for license amendment to be exempt thereunder, and (2) requested'hat we reconsider our position (in our letters to you dated October 10 and November 29) that your September 5, 1978 application for-St. Lucie Unit No.

1 requires a Cl'ass II fee of $1,200.

The last sentence of Footnote.2 of 10 CFR 170.22 was included in the current regulations to cover actions such as. Commission requests to licensees to convert old form Technical Specifications -to Standardized Technical Specifications and situations requiring that a license or-specification be amended to clarify or resolve an interpretation prob-lem noted by our Office of Inspection and Enforcement.

Such actions, it was concluded, would be for the convenience of NRC, would clarify or simplify the license and/or technical specifications and would have no, or only minor, safety significance.

It was decided that those Class I, II and III amendments which were found necessary and requested by.

NRC Hut did not meet all the criteria of Footnote 2
