This office has received a copy of your September 8, 1978 application for amendment to Facility Licenses DPR-31 and DPR-41 which you filed with the Office of Nuclear Reactor Regulation.

The application relates to the surveillance requirements for the diesel generator units used as the onsite A.C. power source at Turkey Point Units 3 and 4.

The appli-cation was not accompanied by an amendment fee as prescribed by Section 170.22 of 10 CFR 170.

In your application you stated that no license amendment fee was required because the request was initiated in response to an NRC staff request and it has only minor safety significance.

The last sentence of Footnote 2 of Section 170.22 exempts Class I, II, or III type antendments which result from a written Commission request provided (1)'he requested amendments are to simplify or clarify the license or technical specifications, (2) the amendments have only minor safety significance, and (3) they are being issued for the convenience of the Coranission.

Although the above application was precipitated by Commission request, has no safety significance, and is pro forma in nature, it is not being considered for the convenience of the Commission nor is it to simplify or clarify the Turkey Point Technical Specifica-tions.

On this basis, it is not exempt from fees under the provisions of Footnote 2. It is requested, therefore, that you promptly forward Class II ($1,200) and Class I ($400) fees totalling $1,600 to this office.

Fees are payable to the U.S. Nuclear Regulatory Commission by check, draft, or money order. If after the final evaluation of your application is completed it is determined that it was incorrectly classified, you will be notified.
