AND NOTICE OF
VIOLATION
Dear Mr. Fitzpatrick:
On October 25, 1996, the NRC completed
a motor-operated
valve inspection at your
D. C. Cook Units
1 and 2 reactor facilities. The purpose of the inspection effort was to
determine whether activities associated
with Generic Letter (GL) 89-10, "Safety-Related
Motor Operated Valve (MOV) Testing and Surveillance," were sufficiently complete to
recommend close-out of the NRC's review of your MOV program.
The enclosed report
presents the results of that inspection.
Areas examined during the inspection are identified in the report.
Within these areas, the
inspection consisted of a selective examination of procedures
and representative
records,
interviews with personnel,
and observation of activities in progress.
At the conclusion of
the inspection and on a subsequent
telephone conference, the findings were discussed
with those members of your staff identified in the enclosed report.
Even though significant progress has been made over the past year to complete your MOV
program, this inspection determined that your MOV program was not sufficiently complete
to close-out the NRC's review of the GL 89-10 program.
Although many aspects of your
program have been adequately addressed,
several issues need to be resolved prior to
closure.
Issues requiring further justification or evaluation are identified throughout the
inspection report.
As discussed with your staff, the closure of your GL 89-10 program will
be considered after you submit a letter documenting additional information pertaining to
these issues.
We will evaluate this information and, if these areas are determined to be
acceptable,
recommend closure of your program.
Based on the results of this inspection, the NRC has determined that one violation of NRC
requirements occurred.
The violation is cited in the enclosed Notice of Violation (Notice)
and the circumstances
surrounding it are described
in detail in the subject inspection
report.
We are concerned that this violation represents
another failure to initiate a
condition report and to perform a prompt operability evaluation.

condition reports or perform operability determinations were a subject of a previous
violation (50-315/96006-01; 50-316/96006-01).
Because of the highly technical nature
of the MOV program, the corrective actions stated for the previous issued violation would
not appear to address
our concern in this area.
Response to this violation, although it can
reference the previous corrective actions, should specifically address how potentially
adverse information received by the MOV group will be handled in the future with respect
to valve operability.
In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of this letter,
its enclosures,
and your response
will be placed in the NRC Public Document Room.
We will gladly discuss any questions you have concerning this inspection.
