NOTICE OF VIOLATION Indiana Michigan Power Company Donald C.
Cook Nuclear Power Plant Docket No. 50-316 License No. DRP-74
- As a result of the inspection conducted from June 4 through July 1,
- 1994, a
violation of NRC requirements was identified.
In accordance with the "General Statement of Policy and Procedure. for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1994), the violation is listed below:
10 CFR Part 50, Appendix B, Criterion XVI, "Corrective Action," requires in part that "Measures shall be established to assure that conditions adverse to quality are promptly identified and corrected.
In the case of significant conditions adverse to quality, the measures shall assure that the cause of the condition is determined and corrective action taken to preclude repetition."
Contrary to the above, as of July 1, 1994, the licensee failed to replace the pitted valve stem on main steam stop valve (MSSV) dump valve test selector, 2-MM0-240, a significant condition adverse to quality.
Specifically, Action Request 25594 had been written on July 8, 1992, to replace the pitted valve stem but was not scheduled to be performed until the refueling outage starting in September 1994.
Consequently, 2-MMO-240 had to be repacked five times requiring entries into the four hour Limiting Condition for Operation (LCO),
as required by Technical Specification (TS) 4.7. 1.5. 1.
There were several opportunities since July 1992 to replace the stem without entering this LCO.
This is a Severity Level IV violation (Supplement I). (50-316/94013-02)
Pursuant to the provisions of 10 CFR 2.201, Donald C. Cook is hereby required to submit a written statement or explanation to the U. S. Nuclear Regulatory Commission, ATTN; Document Control Desk, Washington, D.
C.
20555 with a copy to the Regional Administrator, Region III, and a copy to the NRC Resident Inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting the Notice of Violation (Notice).
This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps
'hat have been taken and the results
- achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.
If an adequate.reply is not received within the time specified in the Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken.
Where good cause is shown, consideration will be given to extending the response time.
Under the authority of Section 182 of the Act, 42 U.S.C.
2232, this response shall be submitted under oath or affirmation.
