This refers to the telephone
enforcement
conference
conducted
by
Hr.
W. Axelson
and other members of the
NRC staff with you and other members
of your staff on March 2,
1993,
regarding activities authorized
by
NRC
Operating
License
Nos.
and
DPR-74 for the D.
C.
Cook Nuclear
Power
Station,
Units
1 and 2.
The purpose of the conference
was to discuss
the
circumstances
surrounding the January
26,
1993,
shipment of an empty package
to the quadrex
Recycle Center which exceeded
Department of Transportation
package radiation limits.
This matter
was also discussed
in Inspection
Report
Nos. 50-315/93007
and 50-316/93007
sent to you on February
19,
1993.
A report
summarizing the enforcement
conference
held
on March 2,
1993, is enclosed.
Based
on the results of our inspection,
certain of your activities appeared
to
be in violation of NRC requirements,
as specified in the enclosed
Notice of
Violation (Notice).
The violations involve shipment of an empty box which
exceeded
Department of Transportation
(DOT) contact
dose rate limits, and
failure to ensure
the limits were met prior to shipment.
These violations
were considered
for escalated
enforcement
but because
of the minimal safety
significance
each
have
been catergorized
The contact
dose rates
were less
than those
allowed for a radioactive material
shipment
which diminished rapidly because
the source
was essentially
a point particle,
and the opportunity for exposure to public was remote.
You are required to respond to this letter and should follow the instructions
specified in the enclosed
Notice when preparing your response.
In your
response,
you should document the specific actions
taken
and
any additional
actions
you plan to prevent recurrence.
After reviewing your response
to this
Notice, including your proposed corrective actions
and the results of future
inspections,
the
NRC will determine whether further
NRC enforcement
action is
necessary
to ensure
compliance with NRC regulatory requirements.
In accordance
with 10 CFR 2.790 of the NRC's "Rules of Practice,"
a copy of
this letter, its enclosure
and your responses
will be placed in the
NRC Public
Document
Room.
