WITHDRAWAL OF AMENDMENT REQUEST REGARDING TECHNICAL SPECIFICATION (TS) 4.0.3 (TAC NOS.
M79836 AND M79837)
By letter dated February 25, 1991, you requested that the operating licenses for the Donald C.
Cook Nuclear Plant, Units 1 and 2, be amended to incorporate some of the guidance contained in Generic Letter (GL) 87-09.
Specifically, you requested that TS 4.0.3 be modified to allow 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> to perform a
surveil-lance if a surveillance requirement is missed.
This amendment request was revised and additional information was provided in your letter dated February 13, 1992.
The NRC staff reviewed the license amendment request and in a phone conversation held on November 25,
- 1992, informed your staff that the submittal did not adequately conform to the guidance in GL 87-09.
Your staff notified the NRC during a phone conversation on December 10, 1992, that the amendment request would be withdrawn.
One of the intents of GL 87-09 was to provide a 24 hour2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> grace period to perform a surveillance that could not be completed prior to entering a
particular mode of operation.
This would give the licensee a reasonable amount of time to perform a surveillance or request a temporary waiver of compliance once the applicable mode was entered without having to immediately enter the ACTION statement.
Generic Letter 87-09 very clearly states that, "Under Specification 4.0.3, the failure to perform a Surveillance Requirement will continue to constitute noncompliance with the Operability Requirements of an LCO and to bring into play the applicable Action Statement."
Without this grace period, the LCO ACTION statement will become effective immediately.
