This refers to the routine safety inspection
conducted by Messrs.
E.
R.
Swanson
and N. E. DuBry of this office on August
1 through September
30,
1981, of
activities at D.
C.
Cook Nuclear Plant, Units
1 and 2, authorized
by NRC
Operating Licenses
No. DPR-58 and No. DPR-74 and to the discussion of our
findings with Mr. Shaller
and others of your staff during the course of the
inspection.
The enclosed
copy of our inspection report identifies areas
examined during
the inspection.
Within these
areas,
the inspection consisted of a selective
examination of procedures
and representative
records,
observations,
and
interviews with personnel.
During this inspection,
certain of your activities appeared
to be in non-
compliance with NRC requirements,
as specified in enclosed
Appendix A.
A written response,
submitted under oath or affirmation, is required.
Further,
we are concerned
about the continuing pattern of late and incom-
plete responses
to NRC correspondence
and about another
example of misleading
or incorrect -information being provided to the
NRC.
These
concerns
are
documented in further detail in paragraphs
2.o, 2.p and
8 of the attached
report,
and they were also discussed
during
a meeting held at your Columbus,
Ohio offices on November 2,
1981, which was attended
by me and others of
this office and you and others of your company for the purpose of discussing
your actions in response
to matters
discussed
during the Enforcement
Con-
ference held in our office on August 4,
1981.
In addition to your response
to the items of noncompliance,
please
describe
those actions
you have taken
or plan to take in regard to these matters.
This office considered
escalated
enforcement action for the matter involving
misleading or incorrect information being provided to the
NRC.
However,

to the fact that escalated
enforcement action is pending for similar matters
which were identified prior to this inspection, this action was not taken.
Nevertheless,
we must emphasize
that similar occurrences
can not and will not
be tolerated by the
NRC.
In accordance
with 10 CFR 2.790 of the Commission's
regulations,
a copy of
this letter, the enclosures,
and your response
to this letter will be placed
in the NRC's Public Document
Room. If the enclosures
contain any information
that you or your contractors believe to be
exempt, from disclosure
under
10 CFR 9.5(a)(4), it is necessary
that you (a) notify this office by telephone
within seven
(7) days from the date of this letter of your intention to file
a request for,withholding; and (b) submit within twenty-five (25) days from
the date of this letter
a written application to'his office to wi:thhold such
information.
Section 2.790(b)(l) requires that any such application must be
accompanied
by an affidavit executed
by the owner of the information which
identifies the document'r pa'rt sought'o
be withheld,
and which contains
a
full statement
of the reasons
which a'e the bases for the claim that the
information should be withheld from public disclosure.
This section further
requires
the statement
to address
with specificity the considerations
listed
The information sought to be withheld shall be incor-
porated
as fax as possible into a separate
part of the affidavit. If we do
not hear from you in this regard within the specified periods
noted above,
a
copy of this letter, the enclosures,
and your response
to this letter will be
placed in the Public Document
Room.
We will gladly discuss
any questions
you have concerning this inspection.
