Your letter dated March 24. 1980. filed with the Office of Nuclear Reactor Regulation (ONRR), requested approval-to employ divers to cut the studs welded to the bottom liner and its supports in the replacement of racks in the spent fuel pool of the Donald C.

Cook Unit Nos.

1 and 2.

The approval was granted in a letter dated March 25, 1980, issued by the QNRR staff.

Reviews and approvals relating. to a particular licensed reactor facility should be classified in the same'manner as applications for license amendments and fees determined and paid pursuant to Section 170.22 of 10 CFR 170.

Consequently, your March 24-. filing is subject to the fee provisions of Section 170.22.

This request i's not considered to be a supplement to your spent fuel pool modification application dated November 22, 1978, because that application was approved on October 16, 1979, and did not include a request for the 'use of divers to cut the studs.

Based on guidance from the ONRR staff as a result of a final review of your request, it has been determined that Class III and Class I fees are appropriate because the review involved consideration of a single'afety issue and two essentially identical units. It is requested that the fees totalling $4,400 be promptly submitted to this office.
