We have received a copy of your letter dated November 30, 1979, which transmitted data relating to the D. C.

Cook Unit No.

2 Residual Heat Removal Low Flow Alarm Logic to the Office of Nuclear Reactor Regulation (ONRR) as required by Condition,2.C(3)(L) of License No. DPR-74.

Your filing was not accompanied by license amendment and/or approval fees as, required by 10 CFR 170.22.

You stated that no fees were due because the above filing was in response to a written request by the Commission's staff.

Based on guidance from the.ONRR staff as a result of their preliminary review of your filing and review of the pertinent sections of License No.

DPR-74, it is our understanding that Condition 2.C(3)(L) requires Commission review and approval of the subject data to determine'if it satisfies that license requirement.

Review and approval of'filings required to satisfy license conditions are not considered written Commission requests to simplify or clarify the license or Technical Specifications for the convenience of the Commission.

As such, they are not exempt from fees.

The ONRR staff considers your November 30 filing'to involve a single safety issue requiring a Class III fee of $4,000.

It is requested that this amount be submitted to us promptly. If the final review of your application by the ONRR staff reveals that'his fee is incorrect,-you will be refunded any overpayment'r billed for any additional amount due.
