REQUEST FOR WITHHOLDINGINFORMATIONFROM PUBLIC DISCLOSURE
Dear Mr. Levine:
By letter dated June 4, 1998, Arizona Public Service Company (APS) provided addditional information in response to Generic Letter (GL) 96-06, "Assurance of Equipment Operability and Containment Integrity During Design Basis Accident Conditions" for the Palo Verde Nuclear Generating Station, Unit Nos. 1, 2, and 3, and requested that the information be withheld from public disclosure pursuant to 10 CFR 2.790.
An affidavit dated June 5, 1998, executed by William E. Ide of the Arizona Public Service Company, the owner of the information, was included in the application. Arizona Public Service Company states that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:
"v. Public disclosure of the information is likelyto cause substantial harm to the competitive position of APS because; a.
Development of this information by APS required hundreds of thousands of dollars and thousands of man-hours of effort, A competitor would have to undergo similar expense in generating equivalent information.
b.
In order to acquire such information, a competitor would also require considerable time and inconvenience to develop and validate analytical methods to predict valve gasket leakage behavior due to thermally induced over-pressurization.
c.
The information consists of test data, evaluations, and graphical analysis regarding the leakage behavior of isolated containment penetration systems subjected to thermally induced over-pressurization.
The availability of such information to competitors would enable them to modify and market similar research products to better compete with APS, take marketing or other actions to improve their product's position and avoid developing similar data and analyses in support of their processes and methods."

Levine Ouly 22, 1998 We have reviewed your submittal and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of Arizona Public Service Company statements, have determined that the submitted information, "Pressure Leakage Test Plan on A 3"-1504 Gate Valve Bonnet to Body Gasketed Joint," and the response to the NRC's request for information, sought to be withheld contains trade secrets or proprietary commercial information.
Therefore, we have d'etermined that the additional information, marked as proprietary, willbe withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
Withholding from public inspection shall not affect the right, ifany, of persons properly and directly concerned to inspect the documents.
Ifthe need arises, we may send copies of this information to our consultants working in this area.
We will,of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
Ifthe basis for withholding this information from public inspection should change in the future such that. the information could then be made available for public inspection, you should promptly notify the NRC. You should also understand that the NRC may have cause to review this determination in the future, for example, ifthe scope of a Freedom of Information Act request includes your information.
In ail review situations, ifthe NRC needs additional information from you or makes a determination adverse to the above, you will be notified in advance of any public disclosure.
