SUBJECT: NRC INSPECTION REPORT 50-528/98-12; 50-529/98-12; 50-530/98-12 AND

NOTICE OF VIOLATION

Dear Mr. LeVIne:

From February 17-27, 1998, a corrective action team inspection was conducted at your Palo

Verde Nuclear Generating Station, Units 1, 2, and 3, reactor facilities. Following this inspection,

an exit meeting was held to provide the inspection findings to you and your staff. Further inoffice

inspection was performed from February 29 to April 9, 1998.

Subsequently,

the results of this

inspection were discussed with you, and members of your staff, in a telephonic exit meeting on

April 9, 1998.

Later, on April 9, 1998, your staff telefaxed new information that was related to a

potential violation. That information provided by your staff is attached to the report as

Attachment 2. As a result or our review of this new information, we reconsidered

a potential

violation and determined that no violation occurred.

This finding was provided to your staff by

telephone on April 13, 1998.

The enclosed report presents the scope and results of that

inspection.

The team determined that Palo Verde Nuclear Generating Station had a good corrective action

program.

Conditions that could degrade the quality of plant operations were, for the most part,

being effectively identified, resolved, and prevented.

However, two violations were identified during the inspection.

The first violation concerns two

examples of a failure to followthe requirements of your condition reporting procedure.

We found

that the root cause had not been determined, as required by your procedure, for the failure of a

procedure preparer, reviewer, and management

approver to specify the correct acceptance

criterion for neutron flux power daily channel check surveillance requirements in the issued

procedure.

We also found that a violation of Technical Specifications Surveillance

Requirement 4.0.5, for the performance of ASME inservice inspections of portions of the nuclear

cooling system, had not been documented and, consequently, reviewed in a timely manner as

required by your procedure.

The second violation concerns a failure to perform transportability

reviews of adverse conditions, as required by procedures for 27 instrument air system free air

regulator failures.

The violations are cited in the enclosed Notice of Violation (Notice) and the circumstances

surrounding the violations are described in detail in the enclosed report.

Please note that you

are required to respond to this letter and should follow the instructions specified in the enclosed

Notice when preparing your response.

The NRC will use your response,

in part, to determine

whether further enforcement action is necessary

to ensure compliance with regulatory

requirements.

In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of this letter, its

enclosures,

and your response will be placed in the NRC Public Document Room (PDR).
