APS LETTER DATED DECEMBER 6, 1997 ADDRESSING THE USE OF NON-DOCKETED INFORMATIONIN INFORMATIONNOTICE 97-66

Dear Mr. Levine:

In the subject letter you stated that APS was unable to locate docketed information to support the statement in NRC Information Notice (IN) 97-66 that your program had not ensured that the requisite special lenses were readily available to licensed staff for use while wearing respirators or.self-contained breathing apparatus.

We agree that the information supporting the IN was not docketed.

However, the existence of the problem at your station during the specified period was documented in APS "Condition Report / Disposition Request CRDR-97Q291"'dated May 20, 1997, which was reviewed by our inspector.

Given that the problem,was known to exist at Palo Verde, we felt it appropriate to reference that fact in the information notice to support the concept that the issue is a generic problem.

Nonetheless, we agree that information of significance that is contained in routine generic communications should normally be discussed in docketed correspondence.
