Pursuant to a
conversation "with the NRC. Project Manager for Palo Verde on March17,1997, APS is hereby requesting that an unreviewed safety question submitted to the NRC by letter 102-03832-JML/AKK/DRL dated December 27, 1996, Request for NRC Review of Revised Grid Stability Analyses, be reviewed and approved under emergency circumstances in accordance with 10 CFR 50.91 (a) (5).
The emergency circumstances exist because APS was informed on March 11, 1997 that the current application of NRC policy regarding unreviewed safety questions is that plants may not restart following outages with an outstanding unreviewed safety question.
Subsequently, on March 17, 1997, APS was informed that this amendment request hd tt ti di tt ~F'd,tl f, lddt processed under emergency circumstances.
Palo Verde Unit 3 is currently in a refueling outage and is scheduled to enter Mode 2 on March 28, 1997.
As such, sufficient time does not exist to process the unreviewed safety question pursuant to 10 CFR 50.91 (a)
(2) with a 30-day notice period.
Therefore, an emergency situation exists in that failure to act in a timely way would prevent-resumption of'operation.
The emergency circumstances.
did not result from APS failing to act in a timely manner as the amendment request was submitted on December 27, 1996.
