NRC INSPECTION REPORT 50-528/96-08; 50-529/96-08; 50-230/96-08 AND NOTICE OF VIOLATION

Dear Mr. Levine:

Thank you for your July 18, 1996, letter in response to our June 21, 1996, letter and notice of violation. We have reviewed your reply and find that your corrective actions properly addressed the regulatory issues identified in the notice.

Your response did not contest the violation, but you did raise several matters regarding the appropriateness of the violation. Our positions concerning the matters identified in your response are discussed in the enclosure to this letter.

In your cover letter, you expressed a concern that the Inspection Report discussed possible willfulomissions of information by the access applicant.

The inspection did not conclude that the applicant had willfullyomitted information, and we agree with your statement that there was insufficient evidence to prove a willfulomission.

NRC was concerned that APS had granted back-to-back temporary unescorted access to an individual without adjudication of available derogatory information prior to granting the access authorization.

The concern was with the timeliness and completeness of your adjudication of available derogatory information.

We willreview the implementation of your corrective actions during a future inspection to determine that full compliance has been achieved and will be maintained.

ENCLOSURE A.

WillfulOmission of Information Licensee's Position The violation was the result of a screening analyst failing to verify that the previous background investigation had been completed.

This was a personnel error.

NRC's Resolution A full background investigation had not been completed at the time the licensee granted back-to-back temporary unescorted access to the individual. The concern as to what the final disposition would have been is not relevant to the issue at hand.

Without a full background investigation, the licensee could not conduct a proper adjudication.

B.

Authorization Signature Licensee's Position The corrective actions implemented for a previous violation would not have precluded the current violation. The licensee contended that corrective actions for the violation identified in NRC Inspection Report 95-11 involved the implementation of a second person verification where as the violation in NRC Inspection Report 96-08 involved a training deficiency for temporary access authorization personnel.

NRC's Resolution The violations identified in both NRC Inspection Reports were clearly similar in that unescorted access badges were issued without obtaining the required signatures.

The root cause of the violations, personnel failing to ensure the required signatures have been attained prior to approving access, is common to all of the issues.

Therefore, the corrective actions for the previous instances of this violation were ineffective in preventing the recurrence.

C.

Non-Cited Violation Licensee's Position The licensee questioned why the violation was not documented as a non-cited violation.

NRC's Resolution The violation did not meet the criteria specified in Section VII.B.1 of the NRC enforcement Policy for a non-cited violation. This was the third inspection in which difficulties with the administration of the access authorization program were identified. As detailed above, the issues were not insignificant, and included examples for which previous corrective actions were not effective.
