This refers to the reactive inspection conducted
by Dr. Dale A. Powers of this
office,
and the inspectors
listed in the enclosed
report.
on March 26 through
May 22,
1996. at the Palo Verde Nuclear Generating Station,
Units 1.

and 3,
facility.
The purpose of the inspection
was to determine whether activities
authorized
by the license were conducted safely and in accordance
with NRC
requirements.
At the conclusion of the inspection.
the findings were
discussed
with those
members of your staff identified in the enclosed
report.
Areas
examined during the inspection are identified in the report.
These
areas
involved your response
to the stuck fuel assembly
event.
Within these
areas.
the inspection consisted of selective exami~ations of procedures
and
representative
records'nterviews
with personnel.
and observation of
activities in progress.
Overall, our assessment
of your staff's performance
in freeing the stuck fuel assembly
and transporting it to safe storage is very
favorable.
Specifically, your reactive efforts were well coordinated.
conservatives
and fully successful.
The
NRC has determined'owever.
that based
on the results of this inspection.
a violation of NRC requirements
occurred.
This violation is cited in the
enclosed
Notice of Violation (Notice) and the circumstances
surrounding it are
described
in detail in the subject inspection report.
The violation involves
the failure to ensure that the design basis of the upper guide structure
was
maintained.
The violation is of concern
because
the failure to adequately
protect the upper guide structure created
a potential for fuel failure and for
the operating
crews to be exposed to significant radiological hazards.
You are required to respond to this letter and should follow the instructions
specified in the enclosed
Notice when preparing your response.
In your
response.
you should document the specific actions
taken
and any additional
actions
you plan to prevent recurrence.
Your response
may reference
or
include previous docketed
correspondence. if the correspondence
adequately
addresses
the required
response.
After reviewing your response
to this
