PROPOSED INPOSITION OF CIVIL PENALTY SI00,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $ 100,000 will be issued on or about March 7, 1996, to Arizona Public Service Company.
The action is based on a Severity Level III violation involving discrimination against a contract instrumentation and control technicians It should be noted that the supervisor responsible for the discrimination is also being issued a Severity Level III Notice of Violation.
In accordance with the Enforcement Policy, a base civil penalty in the amount of $50,000 is considered for a Severity Level III.
The staff decided to exercise discretion to increase the amount of the civil penalty because the violation went undiscovered and uncorrected for more than 19 months, during which time the overall environment at Palo Verde for raising safety concerns was in need of substantial attention.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:
Mailing of Notice Telephone Notification of Licensee The State of Arizona will be notified.
March 7, 1996 March 7, 1996 The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
