This refers to the inspection

conducted

by Dr. Dale A. Powers

and the

personnel

identified in the enclosed

report

on November 15-17,

November

29

through December

2.

and in-office review until December

16,

1994.

The

insoection included

a review of activities authorized for your Palo Verde

Nuclear Generating Station,

Units

1

~ 2,

and 3. facility.

At the conclusion of

the inspection.

the findings were discussed

with those

members of your staff

identified in the enclosed

report.

Areas examined during the inspection

are identified in the report.

These

areas

included followup of Licensee

Event Report 528;

529; 530/94-002-00

and

its two supplements'hich

discussed

Technical Specification limiting

conditions for operation that were not supported

by safety analysis.

Within

these areas'he

inspection consisted of selective examinations of procedures

and representative

records.

and interviews with personnel.

The purpose of the

inspection

was to determine whether activities authorized

by the license were

conducted safely

and in accordance

with NRC requirements.

Based

on the results of this inspections

certain licensed activities appeared

to be in violation of NRC requi rements,

as specified in the enclosed

Notice of

Violation (Notice).

The violation is of concern

because it reflects

a lack of

timeliness in notifying senior licensee

management

to ensure the prompt

resolution of an engineering technical

issue involving the adequacy of

Technical Specifications for core performance.

However, this specific example

of a violation is much less important than the historical untimeliness

associated

with many of the issues that were discussed

in Licensee

Event

Report 528:

529; 530/94-002-00

and its supplements.

One of the reported

issues

became

apparent to your staff as early as

1988 and

many transcend

the

greater part of this decade.

As evidenced

by your staff's written record

and

our inspection findings'

common perception that was exhibited in your

staff's actions

was

a lack of need for timely decision

making for issues

subject to internal

and external

reporting requi rements.

Clearly,

a lack of

timeliness

was also evident in the need for obtaining satisfactory regulatory

resolutions to outstanding

issues.

We are concerned that this is

a continuing

problem and urge that you take aggressive

action to assure

regulatory issues

are resolved in a timely manner.

Please

ensure that your response

to the

Notice addresses

this concern.
