Dear Mr. Saporito:
This is a final response to your Petition dated October 23,
- 1992, which was filed pursuant to Section 2.206 of Title 10 of the Code of Federal Regulations.
The Petition requested that the Nuclear Regulatory Commission (NRC) order the immediate shutdown of the three units at the Palo Verde Nuclear Generating Station (Palo Verde).
The Petition also requested that the NRC institute a
show cause proceeding to modify, suspend, or revoke the operating licenses fot the Palo Verde units, based on alleged problems with the main steam and pressurizer safety valves and other allegations contained in the Petition.
In a supplement to your Petition dated January 4,
- 1993, you also requested appropriate enforcement action against Arizona Public Service Company (the licensee) and denial of the November 13, 1990, license amendment application requesting an increased setpoint tolerance for the safety valves.
For the reasons stated in the enclosed Director's Decision (DD'-'4-j'ig), your requests are denied.
A copy of this decision will be referred to 'the Secretary of the Commission for the Commission to review in accordance with 10 CFR 2.206(c).
As provided by this regulation, the decision will constitute the final action of the Commission 25 days after the date of issuance unless the Commission, on its own motion, institutes a review of the decision within that time.
