NOTICE OF ENFORCEMENT DISCRETION FOR PALO VERDE UNIT 2 In your letter dated April 9, 1994, you requested that the U. S. Nuclear Regulatory Commiss'ion (NRC) exercise its discretion not to "enforce compliance with the required actions of Technical Specification 3.8.l.l.b, "A. C.

You informed the NRC that Palo Verde Unit 2 would not be in compliance with the requirements of Technical Specification 3.8. 1. 1, Action Statement b, after 12:45 p.m.

on April 9, in that emergency diesel generator B

would have been out-of-service more than 72 hours8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br />, and that TS 3.8.1.1 would then require Unit 2 to be placed in hot standby within the following 6 hours6.944444e-5 days <br />0.00167 hours <br />9.920635e-6 weeks <br />2.283e-6 months <br /> and cold shutdown within the following 30 hours3.472222e-4 days <br />0.00833 hours <br />4.960317e-5 weeks <br />1.1415e-5 months <br />.

You requested enforcement discretion for a period of 18 hours2.083333e-4 days <br />0.005 hours <br />2.97619e-5 weeks <br />6.849e-6 months <br /> beyond the 72 hours8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br /> allowed by Technical Specification Action Statement, to allow for the completion of corrective maintenance on the emergency diesel generator.

In your letter you provided as justification why the additional 18 hours2.083333e-4 days <br />0.005 hours <br />2.97619e-5 weeks <br />6.849e-6 months <br /> that emergency diesel generator B would be inoperable was not safety significant.

You stated that the redundant diesel generators capable of supplying the required power to emergency safeguards and safe shutdown loads, and that this diesel had recently been satisfactorily run and demonstrated operable.

You stated that the projected weather conditions were reviewed for this proposed time frame and determined that there would be no adverse impact on offsite power supplies.

In addition, you stated that you had taken or would take the following compensatory measures:

you verified'hat all train A safety equipment is and will be maintained operable; the non-essential auxiliary feedwater pump will be verified and maintained operable; no non-emergent work will be performed on these train A components; precautions will be taken for the offsite distribution system; and no work will be performed in the switchyard without specific review and approval of the Vice President, Nuclear Production.

You stated that you had performed a Probabilistic Risk Assessment and concluded that the increase to the core damage frequency was 9E-7 for the additional 18 hours2.083333e-4 days <br />0.005 hours <br />2.97619e-5 weeks <br />6.849e-6 months <br />.

This increase in core damage probability was less than that calculated for a forced shutdown with one diesel generator inoperable.

Based on our review of your justification, including the compensatory measures identified above, we have concluded that this course of action involves minimal or no safety impact, and we are clearly satisfied that this exercise 9404200172 940412 PDR ADOCK 05000529 Q

Arizona Public Service Company of enforcement discretion is warranted from a public health and safety perspective.

Therefore, it is our intention to exercise discretion not to enforce compliance with TS 3.8. 1. 1, Action Statement b, for the period from 12:45 p.m.

on April 9, 1994, to 6:45 a.m.

on April 10, 1994.

This letter confirms our verbal granting of enforcement discretion during a telephone call at 12:15 p.m.

Levine of your staff on April 9, 1994.

However, we will consider enforcement
action, as appropriate, for the conditions that led to the need for this exercise of enforcement discretion.

In addition, we note that you have taken prompt action to restore, retest and declare operable Unit 2 emergency diesel generator B in compliance with Technical Specification 3.8. 1.1, Action Statement b, at 12:52 a.m.

on April 10, 1994.
