I am responding to your letter, dated February 9,
- 1994, concerning the El Paso Electric Company bankruptcy the proposed merger/takeover by Central Southwest, and the rates El Paso Electric Company was allowed to charge.
A major mission of the Nuclear Regulatory Commission (NRC) is to assure the public health and safety through the safe operation of nuclear power plants.
The NRC is concerned about'he financial stability of the utility owners to the extent it may affect a utility's ability to support safe operation of the NRC licensed facilities.
Each utility undergoes a financial review for stability by the NRC prior to the NRC issuing the Construction Permit.
In addition, the NRC requires its power reactor licensees, including the El Paso Electric Company to provide funds in an external trust account for eventual decommissioning of its nuclear power plant.
However, the NRC has no jurisdiction over rates charged by the utilities.
These rates are under the jurisdiction of the Federal Energy Regulatory Commission and state public utility commissions.
Therefore, we are unable to address your concerns about the effect of rate increases.
