This letter is to acknowledge receipt of your Petition filed with the Executive Director for Operations (EDO) February 1,
- 1994, requesting that the Nuclear Regulatory Commission take action with regard to the Palo Verde Nuclear Generating Station.
The requests you have made in your Petition and the grounds for these requests are summarized in the attached copy of the notice that is being filed with the Office of the Federal Register for publication that I have enclosed for your information.
Copies of this letter and your Petition will be placed in the NRC's Public Document Room.
Your Petition has been referred to me pursuant to 10 C.F.R.
g 2.206 of the Commission's regulations.
As provided by Section 2.206, action will be taken on your request within a reasonable time.
A letter is being sent to Arizona Public Service Company (APS) concerning your allegations about statements made by Mr. Fallon which you believe discourage Palo Verde employees from raising safety concerns to the NRC.
The letter requests a reply regarding Mr. Fallon's statements which we will consider in our action on your petition.
You will be given the opportunity to comment on APS'eply.
Finally, to assist us in evaluating your Petition, please provide your views as to the basis for the NRC to require APS to refer employees to the Buckeye, Arizona Regional Office of the National Whistleblower Center (Center).
Assuming that NRC has the authority to require your approach, explain why NRC should encourage employees to raise these issues to the Center rather than continuing to use reporting mechanisms to the NRC.
