CLOSURE OF NRC INVESTIGATION NO. 5-91-014 Enclosed for your information is the Synopsis of NRC Office of Investigations (OI) Report No. 5-91-014.
This investigation involved alleged employment discrimination including allegations of a hostile work environment, of wrongful termination of employment, and of downgraded performance appraisals because of an employee's whistleblowing activities.
In Report No. 5-91-014, OI concluded that APS discriminated against an employee by allowing the existence of, a hostile work environment.
On September 30, 1992, the NRC issued a Notice of Violation and Proposed Imposition of Civil Penalty
($80,000) to APS for this matter.
The other concerns reviewed during this investigation were not substantiated.
This concludes our investigative actions related to these issues.
In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice,"
a copy of thi s letter and the enclosure will be place in the NRC Public Document Room.

SYNOPSIS On April 13,
- 1989, and October 31, 1991, the Regional Administrator, Region V, UPS. Nuclear Regulatory Commission (NRC), requested that investigations be initiated.
The purpose of the investigations was to determine whether management of the Arizona Public Service Company (APS), operators of the Palo Verde Nuclear Generating Station
'(PVNGS); harassed, intimidated, and/or discriminated against a
PVNGS systems engineer; terminated the employment of the engineer's son at PVNGS; downgraded the engineer's job performance. appraisals; and changed the conditions of the engineer's employment, all as retaliation against the engineer for raising nuclear safety concerns (ice.,
whistleblowing) in violation of NRC regulations'he Office of Investigations (OI) investigation substantiated, based upon U.S. Department of Labor investigations and hearings, that APS/PVNGS management did discriminate against the engineer by allowing a work environment hostile to the engineer to exist over a extended period of time.
The investigation did not substantiate the allegations that the engineer's son was terminated by APS/PVNGS as retaliation for the engineer's whistleblowing activities.
- Further, the investigation did not substantiate the allegations that APS/PVNGS management downgraded the engineer's job performance evaluations or changed the engineer's conditions of employment as
