This refers to the Nuclear Regulatory
Commission
(NRC) inspection
conducted
on
April 14-18,
1986, at your St.
Lucie facility.
As
a result of this inspection,
significant failures to comply with NRC requirements
were identified.
An
Enforcement
Conference
to discuss
these matters
was held at Juno
Beach,
on May 9,
1986.
The first violation described
in the enclosed
Notice of Violation involves
a
failure to prepare
two boxes of radioactive materials offered for transport
so
that under conditions normally incident to transport
the radiation level
does
not exceed
200 milli rem per hour at any point on the external
surface of the
package.
The remaining
two violations described
in the enclosed
Notice involve
a failure to package
a shipment of low specific activity material
in
a
Specification
7A Type
A package
or
a strong, tight package
and
a failure to
maintain written procedures
regarding respiratory protective
equipment
issuance
records.
In accordance
with the "General
Statement
of Policy and Procedure
for NRC
Enforcement Actions,"
10 CFR Part 2, Appendix
C ( 1986),
the first violation
described
in the enclosed
Notice has
been classified
as
a Severity
Level III
violation.
Normally,
a civil penalty is considered
for a Severity
Level III
violation.
However, after consultation with the Director, Office of Inspection
and Enforcement,
I have decided that
a civil penalty will not be proposed
in
this .case
due to your prior good performance
in this area.
The remaining
two
violations have
been categorized
as Severity Level
IV violations.
You are required to respond
to this letter
and should follow the instructions
specified in the enclosed
Notice when preparing your response.
In your response,
you should document
the specific actions
taken
and any additional actions
you
plan to prevent recurrence.
After reviewing your response
to the Notice,
including your proposed corrective actions,
the
NRC will determine
whether

action is necessary
to ensure
compliance with NRC
regulatory requirements.
In accordance
with Section
2.790 of the

directed

are not subject to the
clearance
procedures
of the Office of Management
