PROPOSED IMPOSITION OF CIVIL PENALTY $ 130,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the total amount of
$ 130,000 will be issued on or about September 30, 1992, to Arizona Public Service Company (APS) for two separate violations of the employee protection provisions of the Commission s regulations, 10 CFR 50.7.
This action is based on two separate findings by two ALJs of the U.S.
Department of Labor (DOL') that APS discriminated against two of its employees, Sarah C.
Thomas and Linda E. Mitchell, for raising safety concerns.
Specifically, a
DOL ALJ found that an APS supervisor retaliated against Sarah Thomas by transferring her to a less desirable assignment and removing her certification.
Another DOL ALJ found that APS management.
had allowed a "hostile work environment" to develop around Ms. Mitchell.
The violation regarding Ms.
Thomas is classified as a Severity Level III violation.
The violation regarding Ms. Mitchell is classified as a Severity Level II violation, prin'cipally because of the actions of APS's then Director of Quality Assurance.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:

September 30, 1992 September 30, 1992 Because both DOL cases are on appeal to the Secretary of Labor, the licensee has thirty days from the date of a final decision by the Secretary on each of the respective cases in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
