50-528, 50-529, and 50-530 Subject PROPOSED IMPOSITION OF CIVIL PENALTIES - $ 162,500 This is to inform the Commission that a Notice of Violation and Proposed Imposition'of Civil Penalties in the amount of $ 162,bOOwill be issued on or about February 3, 1992 to Arizona Public Service Company.
This action is based on two plant events, each of which has been categorized at Severity Level III.
The first event involved a partial loss of offsite power that occurred on November 15, 1991 and resulted in Unit 3 operating in natural circulation.
The'econd event involved core alterations on Unit 2 without a senjbr reactor operator present as required by Technical Specifications.
The base civil penalty for the'irst event was escalated a total of 125% based on 'narrowly focused corrective actions and prior notice of similar events.
The base civil penalty for the second event was not adjusted after offsetting m'itigation for identification and reporting with escalation for corrective actions.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:
Mailing of Notice Telephone Notification of Licensee The State of Arizona will be notified.
February 3, 1992 February 3, 1992 The licensee has thirty days from the date of the Notice in.which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
