This is in response to your letter of April 26 1991, in which you asked us to verify that the Nuclear Regulatory Commission tNRC) did not issue a Federal Government shut down or prohibit total or partial physical use of the units a
alo Verd
'n connection with the outages of all three units in 1989.
I can confirm what you were told by Hr. Charles Trammell on the telephone recently:
the NRC issued no such orders.
The "Confirmatory Action Letters" which you cite confirm actions the utility intended to undertake with respect to a significant problem and also confirm the understanding reached that plant operation (or other action) would not be resumed without NRC concurrence.
As
- such, these letters do not represent a formal enforcement action but rather serve to emphasize the importance NRC attaches to a particular matter.
After completion of the actions stated in a Confirmatory Action Letter, the NRC issues another letter confirming that particular corrective actions have been taken and documents our position with respect to resuming operation.
