IHPOSITION OF CIVIL PENALTY - $75,000 By EN 90-088 dated September 21, 1990, the Commission was notified of the intent of OE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $75,000 to Arizona Public Service Company.
This action was based on a violation involving the failure to have an adequate program to ensure that all licensed operators are medically qualified as required by 10 CFR Part 55.
The licensee responded to the Notice in a letter dated October 25, 1990.
The licensee admitted the violations, as stated, but requested mitigation of the civi 1 penalty.
After careful consideration of the licensee's
- response, the staff has concluded that the licensee did not provide a sufficient basis for mitigation of the civil penalty.

Accordingly,.an Order Imposing Civil Penalty in the amount of $75,000 has been issued today.
Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
